Below there are information about rights relating to ownership and rights under the Act of 4 February 1994 on Copyright and Related Rights (Dz.U. /Journal of Laws/ No. 24, item 83, as amended), applicable to Photographs by Agnieszka Gotowała.
By purchasing my Photograph, you become its owner, however, you do not acquire any copyright to the Work itself, nor do you obtain the right to exercise moral rights. You may use it provided that my personal economic and moral rights are not violated by such use. Under applicable law, you have the right to:
In the case of professional resale (including resale through professional art dealers), I am entitled to a share of the profit from such a sale, i.e. the so-called "droit de suite" (resale or royalty rights), which is the sum of the following rates:

- use the Work within the scope of fair use – i.e. you may make the Work available to persons that you remain in a personal relationship with, particularly, affinity, consanguinity or social relationship. For example, you may share the Work with your loved ones using your private social media account. Making the Work available using a public social media account, or in such a way that it can be seen by a larger audience, shall not be deemed fair use.
- publicly display the Work, e.g. in a gallery or museum, provided that you do not profit from it. Displaying and sharing the Work publicly does not mean displaying and sharing it in a way that enables anyone to access it at a place and time of their choice, e.g. using the Internet.
In the case of professional resale (including resale through professional art dealers), I am entitled to a share of the profit from such a sale, i.e. the so-called "droit de suite" (resale or royalty rights), which is the sum of the following rates:
- 5% of the sale price – for prices equivalent to up to €50,000, and
- 3% of the sale price – for prices ranging from €50,000.01 to €200,000, including other currency equivalents, and
- 1% of the sale price – for prices ranging from €200,000.01 to €350,000, including other currency equivalents, and
- 0.5% of the sale price – for prices ranging from €350,000.01 to €500,000, including other currency equivalents, and
- 0.25% of the sale price – for prices exceeding €500,000, including other currency equivalents
– but no higher than the equivalent of €12,500. This remuneration does not apply in the case of resale for up to €100.
